הודעה מטעם המרכז בעניין התקפת חמאס והמלחמה בעזה
מרכז מינרבה לזכויות האדם באוניברסיטה העברית בירושלים מביע תנחומים למשפחות השכולות, שאיבדו את יקיריהן במתקפת הטרור הנפשעת של ארגון חמאס, מאחל החלמה מהירה לפצועים, וקורא לממשלת ישראל ולקהילה הבינלאומית לפעול בדחיפות להשבת החטופים.
החמאס ביצע וממשיך לבצע מעשים מזוויעים, פשעים נגד האנושות, שכל אדם בר דעת חייב לגנותם באופן נחרץ וחד-משמעי, ללא כל הסתייגות, תהא אשר תהא עמדתו באשר לסכסוך הישראלי-פלסטיני.
בוא בזמן, גם בתוך סערות הנפש לנוכח זוועות שלא ניתן לעכל והדאגה הרבה לגורל החטופים, עלינו לזכור שרבים מתושבי עזה הם אזרחים שאינם מעורבים במעשי חמאס או במעשי איבה נגד ישראל, ואשר חיים בתנאים קשים ביותר. ההכרעה בשאלה מה מותר לממשלת ישראל לעשות, משפטית ומוסרית, בתגובה למתקפה הרצחנית של החמאס, היא קשה. במאמר המצורף מוצע דיון בהיבטים מוסריים של הסוגיה. המאמר מבטא את עמדת מחבריו בלבד.
היבט מרכזי נוסף בתחום זכויות האדם הוא ההכרח הקיומי לפעול להבטחת המשך חיים משותפים לערבים וליהודים במדינת ישראל. על הממשלה וכלל הגורמים בחברה בישראל להיאבק בנחישות בגילויים של אלימות וגזענות כלפי קבוצות בחברה, ובכלל זה כלפי אזרחים ותושבים ערבים.
השתתפות בדיון ציבורי בסוגיות השנויות במחלוקת ציבורית הכרחית לקיומה של חברה דמוקרטית, ולא אחת, הבעת דעה לא פופולארית מחייבת אומץ לב ציבורי. בצד כך שנדרשת מידה רבה של סובלנות כלפי התבטאויות, אפילו הן מרגיזות, על המשתתפים בדיון הציבורי לפעול תוך הכרה בהוראת סעיף 19)3( לאמנה הבינלאומית בדבר זכויות אזרחיות ופוליטיות, שלפיה מימוש חופש הביטוי "נושא עמו אחריות מיוחדת". יש להימנע מהכללות המייחסות תכונות שליליות או מעשים פסולים לאנשים על יסוד מאפיינים קבוצתיים כמו דת, לאום, מגדר וכדומה. על מי שמשתתפים בשיח הציבור להתחשב בהשלכות הצפויות, המכוונות והבלתי מכוונות, של התבטאויותיהם. אסורה לחלוטין הבעת תמיכה במעשי טרור ואסורה לחלוטין הסתה לשנאה, לגזענות, לאלימות או לטרור.
אנו מביעים תקווה לסיום מהיר של המלחמה, לחזרתם בשלום של חיילי צה"ל ולשחרור החטופים, ולשיקומן של אין-ספור המשפחות שחייהן התהפכו באירועים הנוראים הללו.

Statement by the Center on the Hamas Attack and the War in Gaza
The Minerva Center for Human Rights at the Hebrew University of Jerusalem expresses condolences to the families who lost their loved ones in the heinous terrorist attack by Hamas. We wish a speedy recovery to the wounded and call on the Israeli government and the international community to act urgently to bring back all those who have been abducted to Gaza.
Hamas has committed and continues to commit abhorrent acts, crimes against humanity that every rational person must vehemently condemn without reservation, regardless of their stance on the Israeli-Palestinian conflict.
In the midst of the turmoil within each of us, faced with incomprehensible atrocities and the grave concern to those abducted to Gaza, it is important to also remember that many residents of Gaza are civilians not involved in Hamas’ actions or armed hostilities, and live in extremely harsh conditions. The determination of what Israel is allowed to do, both legally and morally, in response to Hamas’ murderous assault is difficult. The attached article presents a discussion of the moral aspects of the issue, expressing the positions of its authors alone.
Another key aspect is the importance of ensuring continued shared life for Arabs and Jews in the State of Israel. The government and all actors in Israeli society must vigorously combat the manifestations of violence and racism towards groups in society, including towards Arab citizens and residents.
Participation in public discourse on contentious issues is essential for the existence of a democratic society. Expressing unpopular opinions requires public courage. While a high level of tolerance towards even provocative expressions is required, participants in the public discourse must keep in mind that the exercise of freedom of expression “carries with it special duties and responsibilities,” as stated in Article 19(3) of the International Covenant on Civil and Political Rights. One should avoid attributing negative characteristics to individuals based on group characteristics such as religion, nationality, gender. Expressions of support for terrorist acts are strictly prohibited, as is incitement to hatred, racism, violence, or terrorism.
We express hope for a swift end to the war, the safe return of IDF soldiers and release of the abducted, as well as the recovery of the countless families whose lives have been turned upside down by these terrible events.
